Deed - Bryan Fairfax to Job Hughley

THIS INDENTURE made the 6th day of September 1777 between Bryan Fairfax of the County of Fairfax of the one part, and Job Hughley of Loudoun County of the other part: 
WITNESSETH: That the said Bryan Fairfax for and in consideration of the rents and covenants hereinafter expressed, doth grant unto the said Job Hughley, for and during the natural life of said Job Hughley, his son Abraham and Tabitha his wife, a certain parcel of land containing 150 acres, lying in the said county, and being part of a larger tract on the west side of Difficult run; bounded according to a survey as followeth: 

Beginning at a red Oak standing on Trammell's Road, etc.... 

He, the said Job Hughley yielding and paying unto the said Bryan Fairfax, his heirs and assigns, on or before the first day of December 1777, the sum of one shilling, current money of Virginia, for every acre of land hereby leased; and from thence forward yearly, every year on the first day of December the like sum of one shilling per acre for every acre of land aforesaid, and the said Job Hughley will within three years from the date of this lease build a dwelling house at least 16 feet square, and such other houses as his occupation may require; and also plant and keep under good fence 100 apple trees, and 100 peach trees; and it is also covenanted and agreed between the parties that the said Job Hughley, his heirs and assigns will not make or tend or suffer to be made or tended, any tobacco or Indian corn on the aforesaid premises except about 5 acres of Indian corn in each year of the aforesaid term; and if it shall happen that all or any part of rent aforesaid shall be unpaid for the space of thirty days after the same shall have become due, if lawfully demanded and no sufficient distress can be found whereby the same may be levied that then it shall and may be lawful for said Bryan Fairfax, his heirs and assigns to re-enter and hold the same as if this deed had never been made; and the said Job Hughley, his heirs or assigns will leave the buildings, fences and orchards in good tenantable repair and will not place any sub-tenant on the premises during the term of this lease.

October 10th, 1805. This is my last Will and Testimony. IN THE NAME OF THE LORD GOD ALMIGHTY, AMEN. To Tibithy Huguely, my beloved wife, I give and bequeath all my possessions after giving a bed and cow to each of my beloved daughters, Nancy, Gimima, Tibitha and after the decease of my beloved wife to have an equal division among each of my children. AS WITNESS my hand and seal.

At a Court for Fairfax County the 15th day of July 1811 this Instrument of Writing purporting to be the Last Will and Testament of Job Huguely, deceased, was presented in Court and the same being proved by the oath of Charles M. Henderson, a Witness thereto who also deposed that William Magruder, a subscribing Witness to the said Will who is since dead subscribed the same in the presence of and at the request of the Testator as also in presence of this Deponent, and that Jacob Huguely who is also a subscribing Witness to the said Will is also dead is Admitted to Record.
