Deed - Bryan Fairfax to Jacob Hugeley
THIS INDENTURE made the 1st day of January 1772 between Bryan Fairfax of the County of Fairfax of the one part, and Jacob Hugeley of Loudoun County of the other part.
WITNESSETH: That the said Bryan Fairfax, for and in consideration of the rents and covenants hereinafter expressed, doth grant unto the said Jacob Hugeley, for and during the natural life of said Jacob Hugeley, his son John and Margaret his wife, a certain parcel of land containing 135 acres, lying in said County, and being part of a larger tract on the west side of Difficult Run; (a stream that flows from south to north and empties into the Potomac).
Jacob Hugeley, his heirs and assigns, paying unto Bryan Fairfax on or before November 1, 1772 one shilling per acre for every acre of land leased. AND the said Jacob Hugeley for himself, his heirs and assigns doth covenant and agree with said Bryan Fairfax that the said Jacob Hugeley will within three years from the date of this lease build a dwelling house at least 16 feet square, and such other houses as his occupation may require; and also plant and keep under a good fence 100 apple trees, and 100 peach trees, and it is also covenanted and agreed between the parties that the said Jacob Hugeley, his heirs and assigns will not make or tend, or suffer to be made or tended, any tobacco or Indian Corn in each year of the aforesaid term; and if it shall happen that all or any part of rent aforesaid shall be unpaid for the space of thirty days after the same shall have become due, if lawfully demanded and no sufficient distress can be found whereby the same may be levied that then it shall and may be lawful for the said Bryan Fairfax, his heirs and assigns to re-enter and hold the same as if this deed had never been made; and the said Jacob Hugeley, his heirs or assigns will leave the buildings, fences, and orchards in good tenantable repair and will not place any sub tenant on the premises during the term of this lease.
